§1. Definition of the Seller

§2 General provisions
1. The Expansa online store conducts retail sales via the Internet pursuant to these Regulations [hereinafter referred to as the Regulations].
2. A consumer is a natural person who concludes a legal act with the Store that is not directly related to his or her business or professional activity (Article 22 of the Civil Code).
3. Entrepreneur [hereinafter referred to as Entrepreneur] is a person/entity/organization concluding a legal transaction with the Store related to its business and/or professional activity.
4. The Regulations are an integral part of the sales agreement concluded with the Customer/Entrepreneur.
5. The prices given in the Store are gross prices (including VAT).
6. Goods available in the Store are new and free from physical and legal defects.
§3 Orders
1. Orders can be placed as follows:
• via the form available on the Store’s website (customer’s basket),
• by e-mail to the address available on the Store’s website,
• by telephone using the telephone number available on the Store’s website.
2. The condition for the order to be fulfilled is that the Customer/Entrepreneur provides data allowing for the verification of the Customer/Entrepreneur and the recipient of the goods. The Store confirms the acceptance of the order by sending a message describing the subject of the order to the e-mail address provided when placing the order. In the event of incomplete, incorrect, contradictory information provided by the Customer/Entrepreneur when placing the order, the Store will contact the Customer/Entrepreneurs to remove the errors.
3. The parties are bound by the information visible on the Store’s website next to the purchased goods at the time of placing the order. This applies in particular to: price, characteristics of the goods, their features, elements included in the set, delivery dates and method.
4. The information on the Store’s website does not constitute an offer within the meaning of the Civil Code. By placing an order, the Customer/Entrepreneur makes an offer to purchase a specific product.
5. By placing an order, the Customer/Entrepreneur makes an offer to conclude a sales contract for the ordered products.
6. After placing an order, a message is sent to the specified e-mail address with information about the next stages of order fulfillment: • after the Customer/Entrepreneur places an order, the Store sends to the e-mail address provided by the Customer/Entrepreneur information about accepting the order for fulfillment. Information about accepting the order for fulfillment is the Seller’s declaration of acceptance of the offer referred to in §3 section 5 above and upon its receipt by the Customer/Entrepreneur, the Sales Agreement is concluded.
5. By placing an order, the Customer/Entrepreneur makes an offer to conclude a sales contract for the ordered products.
7. After concluding the Sales Agreement, the Store confirms its terms to the Customer/Entrepreneur by sending them to the e-mail address of the Customer/Entrepreneur or in writing to the postal address indicated by the Customer/Entrepreneur when placing the order.
8. In case of choosing the payment method by bank transfer, the order completion date will be counted from the moment when the funds for the Customer/Entrepreneur’s order are credited to the Store’s bank account.
9. The Store is liable to the Customer under the warranty law, regulated by the Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) for a period of 24 months. A disk drill crack detailed description of the complaint procedure can be found in §6 of these regulations. Liability for defects is specified by applicable legal regulations, in particular art. 12 section 1 item 13 of the Consumer Rights Act (Journal of Laws 2014 item 827, as amended), art. 556 and 5561-5563 of the Civil Code (Journal of Laws 1964 No. 16 item 93, as amended).
10. The store is not responsible for:
• verification of projects sent by the Entrepreneur/Client,
• color and content errors in the submitted designs,
• failure of the Entrepreneur/Client to adapt the designs to the specifications provided on the Store’s websites,
• deviations in the color of the product from the design caused by a poorly prepared design,
• technical errors in the project files (fonts, offsets, lack of legality, transfer errors).
11. The Store provides detailed technical specifications and guidelines for the correct preparation of the project by the Entrepreneur/Client. They are located in the creator used to add materials.
§4 Payments
1. The Customer/Entrepreneur can choose from the following payment methods:
• electronic payment via the przelewy24 service, integrated with the online store
• payment by bank transfer (prepayment).
2. Shipping prices are specified in the order summary.
3. The condition for the release of goods is payment for the goods and shipment.
4. In case of choosing payment by bank transfer, the amount due should be settled within 7 working days from the moment of confirmation of the order by the Store. Otherwise, the Store will cancel the order.
§5 Shipping of goods
1. The Store sends the ordered goods via courier companies or makes them available for personal collection at the Store’s headquarters.
§6 Complaints
1. In the event of non-conformity of the itubego registration key goods with the contract, the Customer should return the complained goods to the Store together with a description of the non-conformity. 2. The Store will respond to the Customer’s complaint within 14 days from the date of return of the goods together with a description of the non-conformity.
3. If the implementation of a justified complaint involves sending a new product to the Customer or removing the non-conformity, the delivery costs are borne by the Store.
4. Each Client may use out-of-court methods of handling complaints and pursuing claims. In this respect, the Client may use mediation. Lists of permanent mediators and existing mediation centers are made available and provided by the Presidents of the relevant District Courts. 5. The complaint form template constitutes an appropriate annex to the Regulations.
6. The Store is liable to the Customer under warranty law, regulated by the Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) for a period of 24 months. Liability for defects is specified by applicable legal provisions, in particular art. 12 section 1 item 13 of the Consumer Rights Act (Journal of Laws 2014 item 827, as amended), art. 556 and 5561-5563 of the Civil Code (Journal of Laws 1964 No. 16 item 93, as amended).
7. Pursuant to the Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) Article 558 paragraph 1, the Store excludes liability under warranty to the Entrepreneur.
8. When a defect occurs, the Customer may request from the Store (under warranty law):
• exchange the goods for new ones;
• repair of goods;
• price reduction;
• Withdrawal from the contract – if the defect is significant. The Store will respond to the Customer’s requests within 14 days of receiving the request. The Store will consider the Customer’s requests, taking into account the following circumstances:
• ease and speed of replacing or repairing goods;
• the nature of the defect – significant or insignificant;
• whether the goods have been previously complained about.
9. The Store may refuse the Customer’s request to replace or repair the goods provided that the replacement or repair of the goods is impossible to implement (eg due to the cessation of production of certain parts or the entire goods), or would require excessive costs compared to the second possible request (eg a request to replace the entire item with a new one if the damage concerns one element of low value). In such a case, the Store will propose an alternative solution.
10. Any disputes arising from the Regulations or sales agreements may be resolved through mediation (more information can be found at: https://uokik.gov.pl/wazne_adresy.php#faq595 ) or via the internet platform http://ec.europa.eu/consumers/odr/
§7 Right of withdrawal
1. Pursuant to the Consumer Rights Act of 30 May 2014, the Customer has the right to withdraw from the contract without giving any reason.
2. Withdrawal from the contract is effective if the Customer submits a declaration of withdrawal from the contract within 14 days from the date of delivery of the goods. To meet the deadline, it is sufficient to submit the declaration before its expiry. The form of the declaration may be any, e.g.
• the declaration may be submitted on a form, the template of which is an annex to the Consumer Rights Act of 30 May 2014 (constituting an appropriate annex to these regulations),

3. The Customer returns the goods to the Store within 14 days of submitting the declaration of withdrawal from the contract at his/her own expense.
4. Within 3 working days of receiving the shipment, the Store employee will check the condition of the delivered product.
5. The Store shall return the funds within 14 days of receiving the declaration. The Store may withhold the return of payments received from the Customer until the item is received back or the Customer provides proof of sending it back, depending on which event occurs first.
6. The Store returns the funds using the same payment method that the Customer used. In the case of payment by payment card, the refund is made to the card account.
7. If the Customer has chosen a method of delivering the item other than the cheapest offered by the Store, the Store will not refund the Customer for any additional costs incurred. The Store will only refund the cost of the cheapest delivery of the item to the Customer.
8. Klient pokrywa wszystkie bezpośrednie koszty zwrotu rzeczy (np. koszty opakowania, zabezpieczenia, nadania).
9. Prawo odstąpienia nie przysługuje Klientowi w przypadkach umów:
• w której przedmiotem świadczenia jest rzecz nieprefabrykowana, wyprodukowana według specyfikacji Klienta lub służąca zaspokojeniu jego zindywidualizowanych potrzeb; (np. wydruk z projektów dostarczonych przez Klienta)
• w której przedmiotem świadczenia jest rzecz dostarczana w zapieczętowanym opakowaniu, której po otwarciu opakowania nie można zwrócić ze względu na ochronę zdrowia lub ze względów higienicznych, jeżeli opakowanie zostało otwarte po dostarczeniu;
• dostarczanie treści cyfrowych, które nie są zapisane na nośniku materialnym, jeżeli spełnianie świadczenia rozpoczęło się za wyraźną zgodą Klienta przed upływem terminu do odstąpienia od umowy i po poinformowaniu go przez Sklep o utracie prawa odstąpienia od umowy;
• w której przedmiotem świadczenia jest rzecz ulegająca szybkiemu zepsuciu lub mająca krótki termin przydatności do użycia;
• w której przedmiotem świadczenia są nagrania dźwiękowe lub wizualne albo programy komputerowe dostarczane w zapieczętowanym opakowaniu, jeżeli opakowanie zostało otwarte po dostarczeniu;
• o świadczeniu usług, jeżeli Sklep wykonał w pełni usługę za wyraźną zgodą Klienta, który został poinformowany przed rozpoczęciem świadczenia, że po spełnieniu świadczenia przez Sklep utraci prawo odstąpienia od umowy;
• w której cena lub wynagrodzenie zależy od wahań na rynku finansowym, nad którymi Sklep nie sprawuje kontroli i które mogą wystąpić przed upływem terminu do odstąpienia od umowy;
• w której przedmiotem świadczenia są rzeczy, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami;
• w której przedmiotem świadczenia są napoje alkoholowe, których cena została uzgodniona przy zawarciu umowy sprzedaży, a których dostarczenie może nastąpić dopiero po upływie 30 dni i których wartość zależy od wahań na rynku, nad którymi przedsiębiorca nie ma kontroli;
• w której Klient wyraźnie żądał, aby Sklep przysłał do niego przedstawiciela w celu dokonania pilnej naprawy lub konserwacji (jeżeli Sklep świadczy dodatkowo inne usługi niż te, których wykonania Klient żądał, lub dostarcza rzeczy inne niż części zamienne niezbędne do wykonania naprawy lub konserwacji, prawo odstąpienia od umowy przysługuje Klientowi w odniesieniu do dodatkowych usług lub rzeczy);
• dostarczanie dzienników, periodyków lub czasopism, z wyjątkiem umowy o prenumeratę;
• zawartej w drodze aukcji publicznej;
• świadczenie usług w zakresie zakwaterowania, innych niż do celów mieszkalnych, przewozu rzeczy, najmu samochodów, gastronomii, usług związanych z wypoczynkiem, wydarzeniami rozrywkowymi, sportowymi lub kulturalnymi, jeżeli w umowie oznaczono dzień lub okres świadczenia usługi.
10. Prawo odstąpienia od umowy bez podawania przyczyny nie przysługuje Przedsiębiorcy.
11. Klient ponosi odpowiedzialność za zmniejszenie wartości rzeczy, będące wynikiem korzystania z niej w sposób wykraczający poza konieczny do stwierdzenia charakteru, cech i funkcjonowania rzeczy.
§8 Konto Klienta/Przedsiębiorcy
1. Klient/Przedsiębiorca może założyć w ramach stron internetowych Sklepu Konto pozwalające na spersonalizowane zakupy, podgląd historii zamówień, podgląd statusów zamówień, zmianę danych wysyłkowych, dostęp do promocji, uproszczenie procesu zamówienia.
2. Sklep nie pobiera żadnych opłat za prowadzenie Konta Klienta/Przedsiębiorcy.
3. Klient/Przedsiębiorca może założyć Konto wypełniając odpowiednie formularze interaktywne zawarte na stronach internetowych Sklepu.
5. Każdy Klienta/Przedsiębiorca może w dowolnym momencie usunąć Konto rozwiązując tym samym umowę o świadczeniu usługi prowadzenia Konta. Usunięcia Konta można dokonać:

W wiadomości email powinny się znaleźć dane pozwalające na identyfikację właściciela Konta, oraz informacja o chęci rozwiązania umowy,

6. Klient/Przedsiębiorca powinien zachować w tajemnicy hasło do Konta.
7. Sklep może odmówić rejestracji gdy dane podane podczas rejestracji budzą uzasadnione wątpliwości co do prawdziwości i rzetelności.
8. Pursuant to the Consumer Rights Act of 30 May 2014, the Customer has the right to withdraw from the contract without giving a reason. The right to withdraw from the contract is effective if the Customer sends a declaration of withdrawal from the contract within 14 days from the date of creation of the Customer Account. To meet the deadline, it is sufficient to submit the declaration before its expiry. The form of submitting the declaration may be any, e.g.
• the declaration may be submitted on a form, the template of which is an annex to the Consumer Rights Act of 30 May 2014 (constituting an appropriate annex to the regulations),

The right to withdraw from the contract does not apply if the Store has fully performed the service with the express consent of the Customer (in particular: when the Customer has placed an order).
9. The agreement regarding the provision of the Account management service is of an indefinite nature, subject to the following sentence. The Client/Entrepreneur may terminate the agreement at any time during the provision of the service by contacting:

10. The agreement regarding the provision of the Account management service is terminated with immediate effect upon confirmation of the data by the Store.
11. In justified cases (e.g. gross violation of the provisions of the Regulations by the Customer/Entrepreneur), the Store may terminate the contract by giving seven days’ notice.
§9 Intellectual Property
1. It is prohibited to use any materials published on the Store’s website (including photos and descriptions of goods) without the written consent of the Store.
2. By delivering the project, the Client/Entrepreneur declares that he/she has full rights to it and all necessary licenses.
3. The store does not archive the submitted designs, nor does it use them for any purpose other than the execution of sales contracts.
§10 Privacy Policy
1. By placing an order and creating an account in the Store, the Customer/Entrepreneur consents to the processing of his/her personal data solely for the purpose of fulfilling the order/managing the customer account.
2. Processing of personal data consists of entering the first name, last name, postal address, e-mail address and telephone number of the Customer/Entrepreneur into the Store’s database. The Store does not share this data with any external entity.
3. The Customer has the right to access and correct their personal data, demand the cessation of their processing and object to their processing.
4. Any provision of data by the Customer/Entrepreneur is voluntary and it is possible to withdraw consent to their processing and storage at any time. For this purpose, the Store should be informed of such a decision in any way, for example:

• via the appropriate tab in the Customer Account Panel
5. The administrator of the provided data is Agencja Reklamowa Expansa Sp. z o. o. – the owner of the Store.
§11 Technical means
1. In order to use the Online Store, including browsing the assortment and placing orders for products, it is necessary to:
a) a terminal device (e.g. computer, tablet, smartphone) with access to the Internet and a web browser such as Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Safari;
b) active electronic mail (e-mail) account;
c) Java scripting enabled;
d) acceptance of the use of cookies (required to place an order).
§12 Special provisions
1. In the scope of services provided electronically by the Store, these Regulations constitute the regulations for the provision of services electronically within the meaning of Art. 8 section 1 of the Act of 18 July 2002 on the provision of services electronically.
2. The types and scope of services provided electronically by the Store are as follows:
– concluding online sales agreements for goods sold by the Store,
– sending e-mails in which the Store confirms receipt of the order and the progress of the order,
3. Procedure for concluding contracts for the provision of services by electronic means:
– in the scope of the online sales agreement and the agreement on the provision of e-mail transmission service, in which the Store confirms receipt of the order, the course of order execution
is specified in paragraph 3 of the Regulations.
4. The conditions for terminating online sales contracts are specified by mandatory provisions of law.
§13 Entry into force and amendments to the Regulations
1. The Regulations come into force on the date of publication on the Store’s website.
2. These Regulations may be changed.
3. Changes to the Regulations will be published on the Store’s website.
4. Information about changes to the Regulations will be sent to the Customer/Entrepreneur who has an account on the Store’s website to the e-mail address indicated in the account settings.
5. Amendments to the Regulations shall enter into force after 14 days from the date of their publication in the manner specified in paragraph 3.
6. The Store considers that the Customer/Entrepreneur who has an account on the Store’s website has accepted the changes to the regulations if he/she has not terminated the contract by the end of the period specified in paragraph 5.
7. In matters not regulated by the provisions of these Regulations, Polish law shall apply.
